About LC. Ghada Fayek

Ghada is a Partner in the general litigation department in Bin Nakhira & Partners.

She is a member in Beirut Bar Association for more than twenty years. 

She worked in managing litigation in both United Arab Emirates and the Middle East region, and played a major role in winning complex cases that contributed to the consolidation of new legal principles and precedents. 

She has an extensive background in a wide range of complex litigation involving commercial, civil, taxation, employment, criminal and administrative matters.

As a specialist in Sustainability policies and in the field of clean energy law, Ghada provides clients the necessary legal advice in these areas. Prior to joining Bin Nakhira & Partners, Ghada worked for one of the most prestigious law firms in Lebanon, and upon her move to the United Arab Emirates, she joined one of the leading law firms, and also worked for the Abu Dhabi Food Control Authority in Abu Dhabi as a legal consultant and researcher and participated in the drafting of several regulations for the said body. 

She has multiple articles published on official and specialized websites. 

She holds a Master Degree in Law, Economic and Management, Field of Public Law, specialized Sustainable Development Law from Paris Descartes University, and currently she is in the process of pursuing a PhD in the field of Nuclear Energy Law and Policies (Civil Liability due to the Peaceful use of Nuclear Energy in United Arab Emirates) from the most prestigious university in Europe.

Achievement

Aclimandos joined the American Chamber of Commerce in Egypt in 1983. He was elected to the board of governors in 1987 and re-elected in 1988 and 2007. Donor Programs committees, and as vice president, membership from 2001 to 2005. Aclimandos was elected President of AmCham Egypt in 2013 and served for two consecutive terms till 2017.

About Dr. Haytham Abdalla

Haytham Abdalla oversees trade litigation at the firm. He assists clients with disputes under domestic, regional and international trade agreements, and provides planning, implementation, assessment and defense of domestic measures, and unjustified compliance issues. During Haytham’s practice in the UAE, he has represented claimants and defendants in over 600 complex trade disputes. 

Haytham started practicing in 1999 in Sudan and in 2010 started practicing in the United Arab Emirates.

In 2011, Haytham was appointed by the Sharjah Chamber of Commerce & Industry and granted rights of audience by the Sharjah Courts to litigate on behalf of the Chamber, making him one of the few expats who have held rights of audience in UAE. 

In 2012 Haytham entered into private practice at top-tier Emirati firm overseeing their commercial litigation matters: Haytham also oversees intellectual property disputes as part of the firm’s trade litigation practice, he has represented domestic and international parties on some of the most prominent landmark decisions in the UAE, for both accused/committed infringers and rights holders.

About Dr. Abdul Wahhab Abdool

Dr. Abdul Wahab Abdool was appointed a second-degree prosecutor on November 6, 1978. On January 22, 1995, he was appointed by a federal decree as a genuine judge of the Federal Supreme Court, thus becoming the first Emirati judge to get to the Federal Supreme Court. On January 29, 2005, he was appointed by a federal decree as the chief justice of the Federal Supreme Court and became the first Emirati to hold this position after more than thirty years of its establishment. He remained chief justice of this Court until he reached the retirement age on 30/6/2016. 

He has many books and research in the field of judiciary and law, through which he elaborated the idea of limits and scope of the relationship between the federal and local judiciary. He also clarified in some of his writings the nature of the relationship between the religious text, particularly the texts of rulings, and the rules of positive law. 

During his tenure as chief justice of the Federal Supreme Court and head of the two constitutional and administrative divisions, he laid down numerous judgments, jurisprudence and judicial principles and created a defiant and sophisticated judicial thought.

Dr. Abdul Wahab had also many legal and judicial participations, such as:

  • Presidency of Lawyers Disciplinary Council.
  • Presidency of technical committees to draft federal laws or amendments to existing laws.
  • Presidency of the Judicial Disciplinary Council.
  • Chairmanship of the advisory councils of the faculties of law at the United Arab Emirates University and Ajman university.
  • Chief or member of academic committees to discuss university theses in faculties of law in the UAE universities. 

Dr Abdul Wahab has received many awards and certificates, including:

  • Knight of Law Award from Comparative Law Institute-Brazil.
  • Honorary Professorship from Eurasian National University Kazakhstan.

About H.E. Mohammed Nekhaira Al-Dhaheri

His Excellency Mohammed Bin Nakhira Al-Dhaheri is the principal founder of the firm. He began his career in the fields of law and judiciary after graduating from the College of Sharia and Law at the United Arab Emirates University in 1982.

After his graduation, he joined the military judiciary and became a member thereof after he received specialized training and courses in the field of military justice, both in investigation and judicial proceedings, until he became deputy director of military justice with the rank of Lieutenant Colonel. 

He was then appointed attorney general of the Federal Public Prosecution, where he was involved in developing the judicial system in administrative and technical areas. He remained in office until February 24, 1997, when he was appointed Minister of Justice, Islamic Affairs and Endowments, thus becoming the first member of the judiciary to head the Ministry of Justice of the United Arab Emirates.

During his tenure as Minister and President of the Supreme Judicial Council, he set out to improve the judicial system in the Ministry of Justice and to regulate and develop work in Islamic affairs. 

He also signed several bilateral agreements with Arab countries and other friendly countries in the field of legal and judicial cooperation, and chaired the Higher Ministerial Committee for Federal Legislation, which earned him accumulated practical experience in the preparation and drafting of texts of laws.

After the end of his tenure at the head of the Ministry on February 16, 2008, he was appointed Ambassador of the UAE to the Arab Republic of Egypt and a permanent delegate to the League of Arab States.

His Excellency provides clients with ingenious resolutions to protect their financial capital ensuring any threat to their goodwill is alleviated.

About Shaikha Abdulla Al Shamsi

She is a licensed lawyer before the state courts since 2020. She holds a Bachelor’s degree in Law from the United Arab Emirates University and is currently pursuing a Master’s degree in Sports Law at the American University in the UAE.

Lawyer Shaikha has extensive experience in various legal fields, representing her clients in criminal cases, family law matters, and civil cases. She also serves as a sports arbitrator and mediator at the Emirates Center for Sports Arbitration, having adjudicated in several disputes presented before the center.

Throughout her career, Lawyer Shaikha has achieved many successes, winning several complex cases. She is known for her ability to litigate before state courts, write legal briefs, and negotiate with clients to achieve the best legal solutions.
